This Privacy Policy explains how Awen Insights, LLC ("Company," "we," "us," or "our") collects, uses, discloses, and protects personal information in connection with our website, applications, and AI-powered dance coaching services (the "Services").
1. Information We Collect
We may collect:
- Account Information: name, email address, password, account type, age or date of birth.
- User Content: uploaded videos, images, practice logs, messages, chat interactions, teacher notes, and related content.
- Performance Data: AI-generated scores, analysis outputs, progress trends, exercise recommendations, and usage history.
- Payment Information: billing and subscription details processed through our payment processor. We do not store full payment card details.
- Device and Usage Data: IP address, browser type, device identifiers, app interactions, pages viewed, and timestamps.
- Communications: support requests, survey responses, and feedback.
- Parent/Guardian Information: email, verification records, and consent records where required for child users.
2. How We Use Information
We use personal information to:
- Provide and operate the Services;
- Analyze uploaded videos and generate personalized feedback;
- Create progress dashboards and reports;
- Process subscriptions and payments;
- Communicate about accounts, updates, and support;
- Improve product performance, safety, and usability;
- Detect fraud, abuse, and security incidents;
- Comply with legal obligations.
3. AI and Automated Processing
We use AI systems and automated tools to analyze dance videos, generate feedback, identify trends, recommend exercises, and support interactive coaching. These outputs may be probabilistic and may not always be accurate.
4. Children's Privacy (COPPA Compliance)
Our Services are designed for dancers of all ages, including children under 13. We comply with the Children's Online Privacy Protection Act ("COPPA") and take the following measures:
a. Parental Consent Requirement
We do not knowingly collect, use, or disclose personal information from children under 13 without first obtaining verifiable parental consent.
- When a child under 13 registers directly, we collect only the child's name, email address, and age, along with a parent or guardian's email address.
- A consent request is sent to the parent/guardian's email with a clear description of the data we collect and how it is used.
- Until consent is granted, the child's account is restricted: they cannot upload videos, receive AI analysis, or access features that involve the collection of additional personal information.
- Parents may grant or decline consent through a secure, tokenized link delivered via email.
b. Teacher-Mediated Access
When a child under 13 registers using a teacher invite code, the teacher represents (per Section 5 of the Terms of Service) that they have obtained appropriate authorization from the child's parent or guardian. In this case, consent is recorded as granted at the time of registration.
c. Information Collected from Children
For children under 13 with valid consent, we collect:
- Account information (name, email, age)
- Uploaded dance videos
- AI-generated scores, feedback, and exercise recommendations
- Practice logs and progress data
We do not collect geolocation data, persistent identifiers for behavioral advertising, or any data beyond what is necessary to provide the Services.
d. Parental Rights
Parents or guardians of children under 13 may at any time:
- Review their child's personal information by contacting us;
- Revoke consent, which will restrict the child's account and prevent further data collection;
- Request deletion of their child's account and all associated data, including uploaded videos, analysis results, practice logs, and account credentials;
- Exercise these rights by clicking the revocation link in the original consent email, using the self-service account deletion feature in account settings, or contacting us at [email protected].
Upon revocation or deletion, we will delete the child's personal information from our active systems and, within 30 days, from our backup systems.
e. No Advertising or Third-Party Sharing
We do not use children's personal information for targeted advertising. We do not sell or share children's personal information with third parties for marketing purposes. Data collected from children is used exclusively to provide AI dance coaching feedback and related educational services.
5. How We Share Information
We may share information:
- With service providers who help us host, process payments, store data, provide analytics, or operate the Services;
- With teachers or dance schools where a user has authorized or requested sharing;
- If required by law, subpoena, or legal process;
- To protect rights, safety, security, or property;
- In connection with a merger, acquisition, financing, or sale of assets.
We do not sell personal information in the ordinary sense of exchanging it for money.
6. Data Retention and Deletion
We retain personal information for as long as your account remains active and as reasonably necessary to provide the Services, comply with legal obligations, resolve disputes, and enforce agreements.
Self-Service Deletion: All users may permanently delete their account and associated data at any time through the Account Settings page. Account deletion removes:
- All uploaded videos and thumbnails from cloud storage
- All AI analysis results, scores, and feedback
- Practice logs, exercise history, and achievement records
- Competitive season data and milestones
- Subscription and payment records (transaction records may be retained by our payment processor as required by law)
- Account credentials and profile information
Teacher Accounts: When a teacher deletes their account, student accounts linked to that teacher are preserved but unlinked. Students retain independent access to their own data.
Backup Retention: Deleted data may persist in encrypted backups for up to 90 days before automatic purging. Backup data is not accessible for operational use after deletion from active systems.
Users may also request deletion by contacting [email protected].
7. Your Choices and Rights
Depending on your location, you may have rights to:
- Access personal information;
- Correct inaccurate information;
- Delete information;
- Receive a copy of certain information;
- Withdraw consent in certain cases;
- Object to or limit certain processing.
Self-Service Account Deletion: You may permanently delete your account and all associated data at any time by navigating to Account Settings and confirming deletion with your email address. This action is immediate and irreversible for active data. Encrypted backup copies are purged within 90 days.
Parents may also exercise rights regarding their child's information where applicable.
8. Security and Data Storage
We use reasonable administrative, technical, and organizational measures to protect personal information, including:
- Encrypted storage: All data is encrypted at rest and in transit.
- Secure cloud infrastructure: Primary data is hosted on secure, US-based cloud infrastructure with role-based access controls.
- Encrypted backups: Database backups are encrypted using AES-256 encryption and stored in Amazon Web Services (AWS) S3 in the United States, with versioning enabled and automatic lifecycle policies that purge backups older than 90 days.
- Access controls: Administrative access to data systems requires authenticated credentials and is limited to authorized personnel.
- Video security: Uploaded videos are stored in private cloud storage accessible only via authenticated, time-limited URLs. Videos are not publicly accessible.
However, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security.
9. International Users
If you access the Services from outside the United States, you understand that information may be transferred to and processed in the United States or other jurisdictions.
10. Third-Party Services
Our Services may contain links to or integrations with third-party services. We are not responsible for those third parties' privacy practices.
11. Policy Updates
We may update this Privacy Policy from time to time. If material changes are made, we will provide notice as appropriate.
